EEOC, known as the Equal Employment Opportunity Commission, receives and investigates charges of discrimination, harassment and retaliation. Workers who file charges of discrimination, harassment or retaliation with the EEOC should have legal representation by an experienced employment lawyer. In addition to making sure the worker’s legal rights are protected and providing legal advice to the worker, an experienced employment lawyer can also investigate the facts through witnesses and documents. Such investigation materials then, depending on the case and time deadlines, might be provided to the EEOC to assist in their investigation. Other times, the employment lawyer’s investigation can be used as part of a lawsuit.
Depending on the facts and circumstances, some cases are best started with EEOC charges. But, other cases are best started through a discrimination, harassment or retaliation lawsuit which would allow the worker’s employment lawyer to have subpoena and other powers to investigate the claims. Whether EEOC charges or a lawsuit is the best starting point depends on the circumstances of each case.
Some Oregon workers have also heard of BOLI, which is the Bureau of Labor and Industries for Oregon. BOLI and the EEOC often work hand-in-hand through a work share agreement. In most cases, BOLI and the EEOC handle the same types of claims. However, state and federal law are different in some ways therefore whether the charge is first filed with BOLI or the EEOC depend on the facts in each particular case.
