Impact of the #MeToo Movement

The #MeToo movement has made a significant impact on workplace harassment laws. Not only are federal, state and local governments working to improve workplace cultures so that sexual harassers are exposed and victims feel more comfortable speaking up, but so are major, well-known companies doing the same.

For example, the #MeToo movement has brought a lot of pressure to companies who force employees to participate in arbitration. After a walkout at Google in early November 2018, several companies including Google, Airbnb, and eBay have all said they will change their policies so that sexual harassment claims are not forced to arbitration.

The federal government has also attempted to address sexual harassment in the workplace. Now, employers who wish to keep a sexual harassment settlement confidential will no longer be allowed to take the settlement as a tax deduction.

Some states have also been doing their part to address sexual harassment in the workplace, including California, which passed laws eliminating provisions which limit the disclosure of sexual harassment and sex discrimination claims.

Still, much more can be done to protect victims, give victims a voice, and keep perpetrators from harming others.
